Heynoon Terms & Conditions — Australia
These Terms govern your use of Heynoon in Australia, including our website, waitlist, provider application forms, and any services or content we make available. Please read them carefully before using Heynoon.
Who we are & what we provide
- Heynoon offers women's health information, digital experiences, and tools to connect you with AHPRA-registered clinicians. Some services are offered via waitlist or early access.
- Heynoon does not provide emergency medical services. In an emergency, call 000 or local emergency services.
- Educational content is informational and not a substitute for professional medical advice, diagnosis, or treatment.
Eligibility and geography
- You must be at least 18 and able to form a binding contract.
- Use Heynoon only if you are located in Australia when accessing AU experiences.
Accounts and information
- Provide accurate information and keep any account or submission details current.
- You are responsible for safeguarding access to your submissions and any credentials you use.
Permitted and prohibited use
- Use Heynoon only for lawful purposes and in accordance with these Terms.
- Do not scrape, reverse engineer, probe, or disrupt the service; do not misuse forms or attempt to access data you are not authorized to access.
- Do not use Heynoon to send unlawful, harmful, or misleading content.
Health content and clinical services
- Clinical services, if provided, are delivered by AHPRA-registered clinicians. They may be subject to separate informed consent and clinical terms.
- Recommendations or care plans are based on information you provide; always consult your clinician for personalised advice.
- Telehealth, if offered, may have clinical and jurisdictional requirements you must accept before receiving care.
Australian Consumer Law
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law that cannot be excluded.
- If any guarantees apply, our liability is limited to the extent permitted by law to resupplying the services or the cost of resupplying the services.
Payments
- If fees apply, pricing will be disclosed before you complete a purchase. You are responsible for charges, taxes, and any third-party fees (e.g., payment processors).
- Refunds or cancellations, if offered, will be described at the point of purchase or in accompanying terms.
Communications
- By providing contact details, you agree we may send service, transactional, and support messages.
- Marketing messages are optional; you can opt out at any time using the provided unsubscribe link or by contacting us.
Intellectual property
- Heynoon content, logos, trademarks, and designs are owned by Heynoon or its licensors. You may not use them without written permission.
Third-party links and services
- Links or references to third parties are provided for convenience. We are not responsible for third-party content, products, or services.
Disclaimers and limitation of liability
- Heynoon is provided “as is” and “as available.” To the fullest extent permitted by law (and subject to the Australian Consumer Law), we disclaim warranties, express or implied.
- To the fullest extent permitted by law (and subject to the Australian Consumer Law), Heynoon is not liable for indirect, incidental, special, consequential, or punitive damages.
- Subject to the Australian Consumer Law and to the extent permitted by law, our total liability for claims arising out of or related to the services will not exceed the amount you paid to us for the service at issue, or one hundred Australian dollars (AUD $100) if no payment was made.
Indemnity
- You agree to indemnify and hold Heynoon harmless from claims arising from your violation of these Terms or misuse of the services.
Governing law and dispute resolution
- These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
- Courts of New South Wales will have non-exclusive jurisdiction, except where a different forum is required by law.
Changes to these Terms
- We may update these Terms. The “Last updated” date will reflect the latest version. Continued use after changes means you accept the updated Terms.
